Employee Left, Visa Not Cancelled? UAE Risks & Penalties

What happens if you don't cancel a UAE visa after an employee leaves: AED 50 a day overstay fines, AED 50,000 harbouring fines, and how to fix it.

Key takeaways

  • If an employer leaves a departed employee's UAE visa uncancelled, the company stays the sponsor on record, and the employee's work permit stays active, which blocks a new employer from issuing the employee a work permit.
  • The Ministry of Human Resources and Emiratisation (MOHRE) says an employer cancelling a work permit must settle any fines for late issuance or non-renewal and confirm the worker has received all entitlements, so a permit left to lapse can cost more to cancel later.
  • The Federal Authority for Identity, Citizenship, Customs and Port Security (ICP) charges a former employee AED 50 per day for staying in the UAE after a visa expires or is cancelled and the grace period ends, so an employee whose visa lapses uncancelled can build fines the employer never sees.
  • Federal Decree-Law No. 29 of 2021 sets a fine of AED 50,000 for employing or harbouring a foreigner in breach of the law, and it exempts a recruiter who reports that the foreigner has left the job; Qawi has found no published fixed fine for late cancellation as such.
  • Free zone companies cancel through their licensing authority, so a free zone employer should confirm its own route and any cancellation fee in writing before it acts.

What happens if you don't cancel a visa after an employee leaves?

Nothing ends the employee's status automatically: the residence and work permits stay valid until someone cancels them or they expire, leaving your company as sponsor of a person who no longer works for you.

Three consequences follow from the official rules. First, the employee's permit stays active, and MOHRE's transfer service requires that a new hire does not hold an active work permit, so a new employer can't process the move. Second, if the work permit lapses without renewal, MOHRE's page says fines for late issuance or non-renewal must be settled before cancellation goes through. Third, Article 5(3) of Federal Decree-Law No. 29 of 2021 requires the contracting entity to notify ICP of changes in the foreigner's work data, within the periods set by the Executive Regulation, which Qawi has not verified.

Neither ICP nor MOHRE publishes a fixed fine for late cancellation by an employer on the pages Qawi checked on 18 October 2026. The exposure sits in the wider rules below.

Who is responsible for cancelling the visa when an employee leaves?

The employer is responsible for the work permit step, and the residence step runs through ICP. For a mainland company, MOHRE handles work permit cancellation and ICP handles residence and Emirates ID cancellation; a free zone company usually starts with its licensing authority.

MOHRE lists these conditions for work permit cancellation: a formal request, complete data and attachments, settlement of fines for late issuance or non-renewal, and confirmation that the worker has received all due entitlements. ICP lists government entities, private entities and free zone establishments among those who can apply for employee residence cancellation.

What penalties can the employer face?

The employer's exposure comes from sponsorship and harbouring rules, and no fixed late-cancellation fine appears on the official service pages. The table below separates what is published from what is not.

Company as a legal personFine, and possible closure of premises for up to six monthsFederal Decree-Law No. 29 of 2021, Article 28

Accurate as of 18 October 2026. Article 25 targets employing, harbouring and recruited-but-unemployed workers, so whether an uncancelled visa on its own triggers it depends on the facts and on the Executive Regulation, which Qawi has not verified. If an employee has vanished or is working elsewhere on your visa, treat Article 25 as live and speak to your PRO desk or a lawyer before the next step.

What fines does the former employee face?

The former employee pays AED 50 per day once the grace period after expiry or cancellation ends. ICP states the fine applies to staying in the UAE after a visa expires or is cancelled, and Article 11 of Federal Decree-Law No. 29 of 2021 leaves the amount to a Cabinet resolution.

Residence category (ICP)Grace period after expiry or cancellation
Golden, Green and Blue Residence holders and their family members180 days
Skilled workers in levels 1 to 3, and property owners90 days
Permits issued with a guarantor or host60 days
All other categories30 days

Accurate as of 18 October 2026. For employers, the point is that an uncancelled residence doesn't start the grace clock, so the daily fines only begin after the permit expires or is cancelled and the grace period runs out.

Can the employee start a new job while the old permit is still active?

No, not through the standard transfer route. MOHRE's transfer work permit page says a candidate for employment may not hold an active work permit, and that the new application must be filed within 90 days of the previous permit's cancellation.

So an uncancelled permit stalls the employee's next job. Once you cancel, the new employer has 90 days to file.

How do you fix it if the employee has already gone?

Cancel the permits now. The numbered list below is for a mainland company; free zone companies follow their licensing authority's route.

  1. Pull the employee's file: contract, last salary, leave balance and gratuity calculation.
  2. Pay final wages and end of service dues, and document that the employee received them; MOHRE lists confirmation of all entitlements as a cancellation condition.
  3. Check the work permit for any fines for late issuance or non-renewal, and clear them through MOHRE.
  4. Submit the work permit cancellation request through MOHRE's service channels.
  5. Apply for residence cancellation on the ICP Smart Services website or ICP Smart App (UAE Pass login); ICP lists AED 50 for the application and AED 100 for Smart Services.
  6. If the employee has stopped coming to work and can't be reached, ask MOHRE how to file a labour complaint for absence from work; MOHRE runs that as a separate service, and its page says no more about timing or effects.

If your records show the employee is still in the UAE and working for someone else on your sponsorship, stop and take advice before filing, because that is the Article 25 scenario.

What most guides don't tell you

A report of the employee leaving may protect you under the law. Article 25(3) of Federal Decree-Law No. 29 of 2021 exempts a recruiter who reports that the foreigner has left the work, as the Executive Regulation provides. Qawi has not verified the Executive Regulation's reporting procedure or deadline, so ask your authority how that report is made and keep the receipt.

A work abandonment case starts with your complaint. The u.ae page on the one-year work permit ban says a worker can't obtain a new permit for a year after leaving the UAE if a work abandonment report against them is proven, and that the employer files a labour complaint with MOHRE. If you never file, there is no official record of what happened.

Family permits can multiply the problem. ICP says family members' permits under a worker's sponsorship must be cancelled before the worker's own residence, or placed on hold for a limited period with applicable fees. ICP also lists a AED 5,000 guarantee fee where a sponsor's permit is cancelled without cancelling family members' permits.

The permit's expiry date is not your deadline. A lapsed work permit adds non-renewal fines that must be settled before cancellation, so waiting for the permit to expire usually costs more, not less.

Which deadlines apply to your company?

Visa cancellations, renewals and labour filings run on different clocks. If you'd rather not track these dates by hand, the free UAE compliance calendar lists them for your company: a free calendar of your company's UAE tax and compliance deadlines, personalised from a few questions, as a PDF and calendar file.

Frequently asked questions

How do I cancel an employee's visa? For a mainland company, you cancel the work permit with MOHRE after settling the employee's entitlements and any late-issuance or non-renewal fines, then cancel the residence permit and Emirates ID through ICP. Free zone companies usually start with their licensing authority.

What are overstay fines in the UAE? ICP applies a fine of AED 50 per day for staying in the UAE after a visa expires or is cancelled, from the day after the grace period ends. The grace period is 30 days for most categories, 60 days for permits issued with a guarantor or host, 90 days for skilled workers in levels 1 to 3 and property owners, and 180 days for Golden, Green and Blue Residence holders.

What is the medical test and Emirates ID process for new employees? ICP lists a medical report among the documents for employee residence, and the Emirates ID is issued and delivered by authorised courier once the application is processed. The employee must complete residency procedures within 60 days of entering the UAE, or delay fines apply.

How do I sponsor my family on a company visa? For the family-of-a-foreign-resident category, ICP requires the sponsor to earn at least AED 3,000 a month plus employer-provided housing, or AED 4,000 if housing isn't provided, and to have adequate housing for the family. Proof of kinship and other documents are also required, and free zones may add steps of their own.
