Amend a UAE Corporate Tax Return: Rules, Deadlines & Penalties

Yes, a filed UAE corporate tax return can be corrected. See the AED 10,000 threshold, the 20-business-day disclosure deadline and the penalties.

Key takeaways

  • A UAE company that finds an error in a filed corporate tax return that understated its tax must correct it; the route depends on size: a voluntary disclosure within 20 business days for errors above AED 10,000, or a correction through a later return for errors of AED 10,000 or less.
  • The 20-business-day clock for a UAE corporate tax voluntary disclosure starts when the company learns of the error, not when the return was filed.
  • Correcting an incorrect corporate tax return before its filing deadline carries no AED 500 incorrect-return penalty; correcting it afterwards through a voluntary disclosure adds 1% of the tax difference per month, running from the day after the return's due date.
  • A UAE corporate tax return is due within nine months of the end of the tax period, so a company with a 31 December year end has until 30 September of the following year.
  • A company that waits for the FTA to notify an audit before disclosing faces a fixed penalty of 15% of the tax difference plus the monthly 1%.

Can you amend a UAE corporate tax return after you've filed it?

Yes, but the route depends on when you spot the error and how big it is. After the deadline the rules give two correction routes, set out in Article 10 of the Executive Regulation of the Tax Procedures Law (Cabinet Decision No. 74 of 2023, as amended).

Before the filing deadline, the penalty schedule itself assumes you can fix a return: the AED 500 penalty for an incorrect return does not apply if you correct it before the deadline. After the deadline, the two routes are a voluntary disclosure or, for small errors, a correction in a later return. The rules cover errors that make your tax payable lower than the amount really due; if you overpaid, speak to the FTA or a registered tax agent about the refund route, because Article 10 doesn't address that case in the text we reviewed.

How does the size of the error decide the correction route?

The dividing line is AED 10,000 of tax difference: above it you must file a voluntary disclosure, and at or below it you can correct the error in a later tax return. Cabinet Decision No. 17 of 2026, effective 1 April 2026, amended Article 10 and, according to published summaries, left the AED 10,000 threshold unchanged.

Say a SHAMS consulting company discovers after filing that it claimed AED 200,000 of expenses that turn out not to be deductible, and the extra corporate tax comes to AED 18,000. That is above the threshold, so a voluntary disclosure is the only route. If the extra tax were AED 6,000, the company could instead correct it in its next return. This is a hypothetical example; your own figure depends on your facts.

What is the corporate tax filing deadline you're measured against?

A corporate tax return is due no later than nine months from the end of the relevant tax period, or by another date the FTA directs. For a company with a calendar-year tax period, that is 30 September of the following year (Federal Decree-Law No. 47 of 2022, Article 53).

The penalties are measured from this date: the AED 500 incorrect-return penalty is waived if you fix the return before it, and the 1% monthly charge on a voluntary disclosure starts the day after it. If you've filed early and spot a mistake, fix it before the deadline and you avoid both.

How do you file a voluntary disclosure for corporate tax?

You file the voluntary disclosure through the FTA in the form and manner the FTA prescribes (Cabinet Decision No. 74 of 2023, Article 10(3)). In practice that means working through your EmaraTax account.

  1. Confirm the error and calculate the tax difference: the extra tax that should have been shown on the original return.
  2. Note the date you learned of the error; the 20-business-day deadline counts from that date.
  3. Log in to EmaraTax and submit the voluntary disclosure using the FTA's current form, with a clear explanation of the error and the corrected figures.
  4. Pay the tax difference within 20 business days of submitting the disclosure; the late payment penalty runs from the day after that date.
  5. Keep the working papers, the corrected computation and the submission record with your corporate tax records.

The FTA's Voluntary Disclosure user guide on tax.gov.ae shows the current screens, which change more often than the law.

What does a correction cost if you leave it late?

A late voluntary disclosure costs 1% of the tax difference for each month or part of a month, from the day after the return's due date until you disclose. The table shows the penalties in Cabinet Decision No. 75 of 2023 (as amended), as of 2 November 2026.

SituationPenaltyWhen it applies
Incorrect tax returnAED 500Not charged if you correct the return before the filing deadline
Error corrected by voluntary disclosure1% of the tax difference per month or part of a monthFrom the day after the return's due date until the disclosure is submitted
No voluntary disclosure before the FTA notifies an audit15% of the tax difference (fixed) plus 1% per monthMonthly charge runs until you disclose, or until the tax assessment is issued if you never do
Late payment of tax14% per annum, charged monthly on the unpaid amountFrom the day after the payment due date; for a voluntary disclosure, payment is due 20 business days after submission

Take the hypothetical AED 18,000 difference again. If the company discloses three months after the return's due date, the disclosure penalty would be roughly AED 540 (1% of AED 18,000 is AED 180 per month, and part of a month counts as a full month), before any late payment charge. If the FTA notified an audit first, the 15% fixed penalty alone would be AED 2,700. Both figures are hypothetical.

What most guides don't tell you

  • The clock starts at discovery, not at filing. The 20 business days run from the date the error came to your knowledge, so the date your accountant or finance manager first noticed it is the date that matters. Record it in writing when it happens.
  • The monthly charge is still running while you work it out. The 1% charge counts from the day after the return's due date, not from the day you found the problem, so a quick disclosure still carries the months already gone.
  • Picking the wrong route can be penalised on audit. Putting a large error into next year's return, instead of filing a disclosure, can look like a failure to disclose if the FTA later audits; the tiered rule exists so that size decides the route, not convenience.

Frequently asked questions

What is the penalty for an incorrect corporate tax return?

The administrative penalty for an incorrect tax return is AED 500, and it does not apply if you correct the return before the filing deadline. If the error understated your tax and you correct it later by voluntary disclosure, a further 1% of the tax difference per month applies (Cabinet Decision No. 75 of 2023, as amended).

How do I pay my corporate tax in the UAE?

You pay through the payment channels the FTA lists on its website and in EmaraTax, so check the current options there before you pay. Payable tax that is paid late attracts a penalty of 14% per annum, charged monthly, on the unpaid amount.

What is a voluntary disclosure for corporate tax?

A voluntary disclosure is the formal notice you give the FTA when you find that a filed tax return or tax assessment understated the tax you owe. It is made under Article 10 of the Tax Procedures Law, and you pay the tax difference within 20 business days of submitting it.

What are the penalties for not filing a corporate tax return?

Failing to file on time costs AED 500 per month or part of a month for the first 12 months, then AED 1,000 per month from the 13th month. The penalty starts the day after the filing deadline.
